1. Acceptance of Terms
By accessing or using the LCBO.dev API (the "API"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the API.
Your use of the API constitutes your acceptance of these Terms. Continued use of the API after any modifications to these Terms constitutes acceptance of the modified Terms.
2. Description of Service
LCBO.dev provides a GraphQL API that offers access to product, store, and inventory data related to the Liquor Control Board of Ontario (LCBO). This service is provided on an "as is" and "as available" basis.
Important: LCBO.dev is not affiliated with, endorsed by, or connected to the Liquor Control Board of Ontario (LCBO) or the Government of Ontario in any way. This is an independent, third-party API service providing access to publicly available LCBO data.
3. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the API solely for lawful purposes.
4. Usage Restrictions
You agree not to:
- Use the API for any unlawful purpose or in violation of any applicable laws or regulations
- Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code of the API
- Use the API in any manner that could damage, disable, overburden, or impair our servers or networks
- Use automated systems (such as bots, scrapers, or spiders) to access the API in a manner that exceeds reasonable usage patterns, as determined by us
- Attempt to gain unauthorized access to any portion of the API or any systems or networks connected to the API
- Use the API to transmit any viruses, worms, defects, trojan horses, or other items of a destructive nature
- Remove, obscure, or alter any proprietary rights notices
- Use the API to compete with or harm our business
- Resell, redistribute, or sublicense access to the API without our express written permission
5. Data Accuracy Disclaimer
THE DATA PROVIDED THROUGH THE API IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND.
While we strive to provide accurate and up-to-date information, we make no representations or warranties regarding:
- The accuracy, completeness, reliability, or timeliness of any data provided through the API
- That the data will meet your requirements or be suitable for any particular purpose
- That the data is free from errors, omissions, or defects
- That the API will be uninterrupted, secure, or error-free
You acknowledge and agree that:
- All data is provided for informational purposes only
- You should verify critical information independently before making decisions based on API data
- We are not responsible for any decisions made or actions taken based on the data provided
- Data may be outdated, incomplete, or inaccurate due to delays in data collection, processing, or transmission
6. No Warranty
THE API IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
We do not warrant that:
- The API will meet your requirements
- The API will be uninterrupted, timely, secure, or error-free
- The results obtained from use of the API will be accurate or reliable
- Any errors in the API will be corrected
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LCBO.DEV, ITS OPERATORS, AFFILIATES, AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your use or inability to use the API
- Any errors, inaccuracies, or omissions in the data provided
- Any decisions made or actions taken based on the data
- Unauthorized access to or use of the API
- Any interruption or cessation of transmission to or from the API
- Any bugs, viruses, trojan horses, or the like that may be transmitted through the API
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT OF ONE HUNDRED CANADIAN DOLLARS (CAD $100.00).
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you.
8. Indemnification
You agree to indemnify, defend, and hold harmless LCBO.dev, its operators, affiliates, and their respective directors, officers, employees, agents, and representatives from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from:
- Your use of or access to the API
- Your violation of these Terms
- Your violation of any third-party right, including without limitation any intellectual property right, privacy right, or proprietary right
- Any claim that your use of the API caused damage to a third party
9. Rate Limiting
The API is subject to rate limiting to ensure fair usage and system stability. You agree to comply with all rate limits and not attempt to circumvent them. We reserve the right to modify rate limits at any time.
10. Intellectual Property
The API, including its design, functionality, and documentation, is protected by copyright, trademark, and other intellectual property laws. All rights not expressly granted to you are reserved by us.
11. Termination
We reserve the right, in our sole discretion, to suspend or terminate your access to the API at any time, with or without notice, for any reason, including but not limited to:
- Violation of these Terms
- Excessive or abusive usage
- Any activity that we determine may harm our systems or other users
- Any other reason we deem necessary
Upon termination, your right to use the API will immediately cease.
12. Modifications to Terms and Service
We reserve the right to modify these Terms at any time. We will notify users of material changes by:
- Posting the updated Terms on this page with an updated "Last Updated" date
- Including a notice in API response headers
Your continued use of the API after such modifications constitutes acceptance of the modified Terms.
We also reserve the right to modify, suspend, or discontinue the API (or any part thereof) at any time, with or without notice.
13. Privacy
Your use of the API is subject to our data collection and usage practices. We may collect and use information about your API usage, including IP addresses, request patterns, and error logs, for the purposes of:
- Providing and improving the API
- Monitoring usage and preventing abuse
- Complying with legal obligations
We do not require user registration or authentication for basic API access, and we do not collect personal information beyond what is necessary for API operation.
14. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario, Canada, without regard to its conflict of law provisions.
Any disputes arising out of or relating to these Terms or the API shall be subject to the exclusive jurisdiction of the courts of the Province of Ontario, Canada.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.
16. Entire Agreement
These Terms constitute the entire agreement between you and LCBO.dev regarding the use of the API and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between you and LCBO.dev.
